When a company reaches the threshold of 100 employees during a social elections cycle, a Works Council (Conseil d’entreprise) must be established.
But what happens if, in the next cycle, the workforce drops below 100 but stays above 50?
👉 In that case, no new elections are held — yet the Works Council continues to exist, from one election to the next.
Its mandate is exercised by the members of the Committee for Prevention and Protection at Work (CPPT), although functioning as a distinct body.
It retains its own powers, structure, and operating rules.
💡 So, keep in mind : As long as the number of employees does not fall below 50, the company keeps an active Works Council maintaining all its specific prerogatives (economic and financial information, consultation on key management decisions, etc.).
